Service Agreement & Policies

Customer Responsibilities:


The customer agrees to provide a safe and secure working environment for Superior Stain Solutions' employees. This includes:

  • Ensuring pets and children are kept away from the work area.

  • Providing access to electricity and water for the project.

  • Informing Superior Stain Solutions of any known hazards or concerns related to the work site.

Touch-Up and Repair Policy:

​

  • Notification Period: The customer must notify Superior Stain Solutions of any touch-ups needed within 7 days from the date of project completion. 

  • Reasonable Touch-Ups: Superior Stain Solutions will perform touch-ups within reason, which includes correcting any missed areas, inconsistencies in staining, or other minor issues related to the initial project scope. Superior Stain Solutions reserves the right to determine what constitutes a reasonable touch-up.

  • Forfeiture of Rights: If the customer does not notify Superior Stain Solutions within the specified 7-day period, they may forgo the right to request touch-ups, and any further adjustments could be subject to additional charges.

  • Exclusions: This touch-up policy does not cover issues arising from misuse, alterations, or damage caused by the customer or third parties after the project's completion.

Warranty and Limitations:


Superior Stain Solutions provides a limited warranty on its workmanship for 12 months from the date of project completion. The warranty covers defects in workmanship but does not cover:

  • Normal wear and tear.

  • Damage caused by misuse, neglect, or accidents.

  • Issues arising from improper maintenance or cleaning by the customer.

  • Changes in wood appearance due to weathering, moisture, or other environmental factors.

Any warranty claims must be made in writing within the warranty period. Superior Stain Solutions will inspect the claimed defect and, if covered, will repair or replace the defective work at no additional cost to the customer.

Site Cleanliness and Protection:


Superior Stain Solutions will take reasonable precautions to protect the customer's property during the project. However, the customer is responsible for removing or protecting any personal items, landscaping, or other property that could be affected by the work. Superior Stain Solutions is not liable for damage to items that were not properly removed or protected.

Insurance:


Superior Stain Solutions carries liability insurance to cover potential damages or injuries that may occur during the project. Upon request, Superior Stain Solutions will provide the customer with a certificate of insurance.

By agreeing to the service agreement, the customer acknowledges and agrees to the terms of the policies listed above.


SERVICE AGREEMENT: By accepting a "quote" or "estimate" from Superior Stain Solutions LLC, the customer agrees to the below conditions.
 

1. Once agreed, the Superior Stain Solutions LLC (“Superior Stain Solutions”) “Quotation” becomes a legally binding contract valid to both parties. The customer assumes all responsibility for ensuring completeness and accuracy of written description, quantities, layout, and specification included in the quotation. Furthermore, any changes in the work, including quantities, layout, and specifications, after the dated signed may result in the need to re-price the project, signature of a new “Quotation” and delays to the anticipated schedule of the project.

2. If customer request changes to work provided for in this agreement, all parties must be notified by the request.

3. Unforeseen Conditions. Superior Stain Solutions will notify Customer as soon as reasonably possible if unforeseen conditions are encountered at the site which are unknown physical conditions of an unusual nature, that differ materially from those normally encountered. Superior Stain Solutions will provide Customer with a change order itemizing the work required to remedy the unforeseen circumstances or if the work will not be able to be completed, Superior Stain Solutions shall inform customer.

4. Superior Stain Solutions is not responsible for any delays in the start of the project due to events that are beyond our control, including but not limited to weather, earthquake, storm, flood, fire, or acts of God, war, riot, public disturbance, strike or lock outs, raw material shortage, prohibitions on exports or imports, government and legislative actions, labor strikes, problems with supply chain and shipment of goods, or any other event beyond the control of the parties, where its occurrence is not preventable or unavoidable. If any of these events happen, Superior Stain Solutions shall not be responsible for any damage, increased cost, or losses that Customer may sustain by reason of the failure or delay of performance. Customer shall be responsible for damage caused by delay, disruption or interference suffered by Superior Stain Solutions during performance of this contract. Customer shall be responsible for any fee increase due to supply chain issues, inflation, or any other reason impacting the cost of goods.

5. Customer assumes all responsibility for choosing a stain in accordance with local and area regulation. Superior Stain Solutions will assume no liability for a violation of HOA, or any other regulation broken by the customers choice.

6. Customer must pay a deposit covering the total cost of goods and materials (Stated by “Superior Stain Solutions”) no closer than 1 week before the project date unless otherwise discussed. All fees for the purchase of goods are non-refundable.

7. Customer agrees to provide proper access to fence, defined as a minimum of 36’’ of clearance between other fences. Cleared area must be devoid of all vegetation, landscaping, and other objects. Customer is also responsible for notifying adjacent property owners of the project and getting any, and all, permission required.

8. If a customer cancels their job after acceptance of the terms and conditions by agreeing to this contract, the customer shall be subject to a $250 cancellation fee. If the customer cancels the job within 48 hours of the agreed-upon start date, the customer shall be responsible for all costs associated with this contract. The customer shall bear the price of all goods purchased for this contract as soon as the goods are purchased.

9. Once the product is delivered to the customer's property, it becomes the property of the customer. Superior Stain Solutions is not liable for lost, stolen, or damaged property. All property is at the sole risk of the customer.

10. Superior Stain Solutions is not liable for the quality of the product delivered by the vendor. Superior Stain Solutions, in good faith and at its discretion, will not install low-quality or broken materials and will replace any damaged material delivered by the vendor before the installation.

11. If delays are caused by the customer, the customer is responsible for the materials and for any storage costs until the project date.

12. If the customer cancels their project or Superior Stain Solutions can no longer do business with the customer for any reason after the delivery of materials, Superior Stain Solutions will not remove the materials, and the deposit becomes non-refundable at this point.

13. Any excess or leftover materials or spares not incorporated into the final project will be the property of Superior Stain Solutions unless otherwise specified in the "Invoice."

14. Customer agrees to make payment in accordance with the terms of the "Invoice." If payment is not made in accordance with payment terms, Superior Stain Solutions reserves the right to pursue a lien placement and repossess all materials used in the staining process, as well as any other remedies available in equity or at law.

15. All "Invoices" are firm for 30 days after the date of the proposal, after which time they are subject to change due to changes in material prices.

16. If Superior Stain Solutions is forced to pursue litigation regarding this contract or the collection of any fees regarding this contract, Superior Stain Solutions is entitled to attorney's fees, court costs, interest on any delayed fees, and any other fees associated with collecting or pursuing this contract.

17. If litigation is required upon this contract, the venue shall be a court of competent jurisdiction in Spartanburg County, South Carolina, with South Carolina as the choice of law.

18. This contract contains the entire agreement of the parties, and there are no other promises or conditions in any other contract, whether oral or written. Any modification of this agreement must be agreed upon by both parties.

19. If any provision of this Contract shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a Court finds that any provision of this Contract is invalid or unenforceable but that by limiting such provisions, it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforceable as so limited.

20. This contract shall only be amended or modified by a written document executed by both parties.
